Most international commercial disputes are decided in private, and the enforceable prize is the award itself. We work on the award and on the part that follows it: recognition and enforcement in the jurisdiction where the assets actually sit.
We also act in negotiations and mediation, which are frequently the better commercial answer and always cheaper than a contested proceeding.
Because the firm is built on a corridor, we are as comfortable in the Ukrainian procedural reality as in the Dutch one, and we do not treat the two systems as an obstacle to be worked around.

When is arbitration the right choice rather than litigation?
Arbitration is usually better where the contract is international, enforcement is expected outside the Netherlands, and the value of the claim justifies the procedural cost. It is usually worse where the counterparty is likely to be insolvent, where speed of interim relief matters, or where a court judgment is needed precisely because it can be enforced against assets.
How do you handle enforcement of an award?
The award has to be enforceable where the assets are, not where the arbitration happened. That means identifying the asset location before enforcement is discussed, and choosing the route — the New York Convention, EU regulations, or national procedure — on that basis.
Does a pre-arbitration letter usually settle the dispute?
Often it does, and that is a good outcome to aim for. It also establishes a clear record of the dispute and the position taken, which matters if the matter does proceed. We write it to be usable as evidence later, not only to sound forceful now.
